1. IMPORTANT NOTICE - SUPPLEMENTAL SECURITY ONLY

Jupyter Security Systems are SUPPLEMENTAL security tools only. They are not a replacement for professional security systems, law enforcement, or personal safety measures. You remain solely responsible for your property's security and personal safety.

2. AI SYSTEM LIMITATIONS & DISCLAIMERS

2.1 No Guarantee of Accuracy

Our AI systems operate on probability and machine learning. We make NO guarantees regarding:

  • Detection accuracy or timing
  • Prevention of any crimes or incidents
  • Correct identification of threats vs. non-threats
  • Consistent performance across all individuals or conditions

2.2 False Positives and Negatives

The system may:

  • Fail to detect actual threats (false negatives)
  • Incorrectly identify non-threats as threats (false positives)
  • Trigger or fail to trigger alarms inappropriately
  • Open/close garage doors for unauthorized vehicles or fail for authorized ones

You acknowledge these limitations are inherent to AI technology and accept all risks.

3. LIABILITY LIMITATIONS

3.1 Complete Liability Waiver

To the maximum extent permitted by law in your jurisdiction, Jupyter is NOT liable for:

  • Any crimes, thefts, or security breaches (whether or not detected)
  • Personal injuries or property damage from any cause
  • Consequences of false alarms or system failures
  • Actions taken or not taken based on system alerts
  • Discrimination claims related to facial recognition performance

3.2 Limitation of Liability

Our total liability for any claim shall not exceed the purchase price of the product. We exclude all indirect, consequential, or punitive damages to the fullest extent permitted by law.

4. DATA PRIVACY & BIOMETRIC INFORMATION

4.1 Local Storage

  • Facial recognition data is stored ONLY on your Hub device
  • Video recordings remain on your local devices
  • We do NOT store biometric data on our servers

4.2 Cloud Services

We collect and store only:

  • Login credentials (encrypted)
  • Event metadata (type, timestamp, labels) for Voice AI
  • System health data (if opted in)
  • Video relay ONLY when P2P connection fails

4.3 Regional Compliance

European Union (GDPR)

By using biometric features, you provide explicit consent under Article 9(2)(a) GDPR. You have rights to access, rectify, and delete your data.

Illinois, USA (BIPA)

We comply with the Biometric Information Privacy Act. Biometric data is stored locally and deleted with your Hub data.

Other Jurisdictions

You are responsible for ensuring use complies with local biometric and privacy laws.

4.4 Your Privacy Responsibilities

You are responsible for:

  • Informing others who may be recorded
  • Complying with local surveillance laws
  • Obtaining necessary consents
  • Not using the system for unlawful monitoring

5. HARDWARE WARRANTY

5.1 Limited Warranty

  • 18-month warranty on internal board defects only
  • Does NOT cover damage from power surges, outages, or external causes
  • Does NOT cover normal wear, misuse, or environmental damage

5.2 User Responsibility

You must pay for repairs/replacement if damage results from external power issues, even within warranty period.

6. USER RESPONSIBILITIES

You MUST:

  • Respond appropriately to all alerts (we provide NO monitoring services)
  • Maintain your equipment and network connectivity
  • Install updates when provided (opt-in basis)
  • Purchase and install a compatible Meross garage door opener (REQUIRED for garage automation features)
  • Test system regularly
  • Maintain appropriate insurance coverage

7. THIRD-PARTY INTEGRATIONS

  • We support RTSP/IP cameras and select garage door openers
  • We are NOT responsible for third-party device failures
  • Integration requires proper credentials and network configuration
  • Compatibility may change without notice

8. PROHIBITED USES

Do NOT use Jupyter systems:

  • As your sole security measure
  • For illegal surveillance or monitoring
  • In violation of privacy laws
  • To harass, discriminate, or harm others
  • In safety-critical applications where failure could cause injury
  • Where facial recognition technology is prohibited by law

9. INDEMNIFICATION

You agree to indemnify and hold Jupyter harmless from all claims arising from:

  • Your use or misuse of the system
  • False alarms or security incidents
  • Privacy violations or unauthorized recording
  • Your failure to respond appropriately to alerts

10. REGIONAL CONSUMER PROTECTIONS

Australia

Nothing excludes rights under Australian Consumer Law that cannot be excluded. We limit liability for consumer guarantee breaches to replacement/repair (our choice).

European Union

EU consumers have statutory rights that cannot be waived. These terms do not affect your statutory rights.

USA

Some states do not allow exclusion of warranties or limitation of liability. In such states, our liability is limited to the minimum permitted by law.

Other Regions

Your local consumer protection laws may provide additional rights.

11. GOVERNING LAW & DISPUTES

11.1 Governing Law

These terms are governed by the laws of Victoria, Australia, except where local law requires otherwise.

11.2 Dispute Resolution

  • For Australian Customers: Binding arbitration in Victoria, Australia.
  • For EU Customers: You may bring claims in your country of residence per EU regulations.
  • For US Customers: Binding arbitration under AAA rules, except where prohibited. Class action waiver applies where permitted.
  • Other Regions: Disputes resolved in Victoria, Australia courts unless local law requires otherwise.

12. UPDATES & MODIFICATIONS

  • We may update software/firmware (opt-in)
  • We may modify these terms with 30 days notice
  • Continued use constitutes acceptance

13. FACIAL RECOGNITION RESTRICTIONS

Some jurisdictions prohibit or regulate facial recognition. You must NOT use these features where prohibited. Currently restricted in:

  • Portland, Oregon (USA) - government use
  • Some EU member states - specific contexts
  • Check your local laws before enabling facial recognition

14. EXPORT CONTROLS

Products contain encryption and may be subject to export controls. You agree to comply with all applicable export laws.

15. ACCEPTANCE

By using Jupyter products, you acknowledge:

  • You have read and understood these terms
  • AI systems are probabilistic, not deterministic
  • You accept all risks of false positives/negatives
  • You will maintain primary security measures
  • You release Jupyter from liability for security incidents
